Direct answer: To renounce inheritance in Turkey from abroad, an heir makes an unconditional oral or written declaration to the competent Turkish civil court of peace, usually through a lawyer holding a properly authenticated power of attorney with specific authority. Under the Turkish Civil Code, the ordinary period is three months, but its starting point is not identical for every heir: a statutory heir’s period generally begins when the heir learns of the death and heirship unless later knowledge is proved, while an appointed heir’s period begins with official notification of the testamentary disposition.
Important-reason extensions and inventory-related rules require individual review. Do not administer, hide, remove or dispose of estate assets beyond necessary preservation while deciding; such conduct can forfeit the right to renounce. This timely express declaration is legally different from “deemed disclaimer,” which concerns an estate whose insolvency was officially established or manifest at death.
Inheritance Renunciation: 2026 legal check
2026 legal check: Under the Turkish Civil Code, the ordinary disclaimer period is generally three months, but its starting point and exceptions depend on how and when heirship became known. A foreign heir may need apostilled civil-status documents, sworn translations and a suitably worded power of attorney. Confirm current court and consular practice before relying on a deadline; renunciation may affect descendants and should not be treated as automatically reversible. The Inheritance Renunciation assessment must use the current official text and the documents in the individual file.
Renounce inheritance in Turkey from abroad: the express filing
Express renunciation is a deliberate procedural act under Articles 609 onward of the Civil Code. The heir declares within the applicable period that the inheritance is refused, and the court records the declaration. It is used even where the estate’s net position is uncertain; the heir does not have to prove manifest insolvency merely to make a timely express declaration.
Article 605(2), by contrast, treats an inheritance as disclaimed if the deceased’s insolvency at death was officially established or clearly apparent. That doctrine may be raised after the ordinary period, often defensively when a creditor proceeds against an heir, but it requires proof of the estate’s condition at death. The dedicated guide on deemed disclaimer of an insolvent Turkish estate covers that evidence. An heir with time to make an express declaration should not rely casually on proving deemed disclaimer years later.
Who may renounce an inheritance?
Both statutory heirs and heirs appointed by a will or inheritance instrument may renounce, subject to the governing succession law and Turkish conflict rules in an international estate. First establish that the person is actually called as an heir. A person who only expects to inherit from someone still alive cannot file a post-death disclaimer. A legatee’s position may differ from that of an heir to the whole estate.
For a foreign decedent, Law No. 5718 may designate foreign national law for succession while Turkish law applies to Turkish immovables and Turkish procedure governs the local court act. Before filing, identify nationality, last residence, Turkish assets and any foreign probate. A foreign renunciation paper is not automatically a Turkish court declaration, and a Turkish declaration may not dispose of foreign assets under another country’s law.
How the three-month period starts
The headline rule is three months, but the trigger must be proved. A statutory heir generally counts from learning of the deceased’s death unless the heir proves that heirship was learned later. An appointed heir generally counts from official notification of the testamentary disposition. A rumour, family message, civil-registry notice and formal opening of a will may have different evidential significance.
Protective inventory and formal official-inventory procedures can affect the decision framework and statutory timing. The court may extend the period or grant a new period for an important reason under the Code, but that is judicial relief, not an automatic overseas extension. Living abroad, waiting for an apostille or not knowing Turkish law should not be assumed sufficient. Calculate the earliest plausible trigger and act within it where possible.
| Heir/situation | Ordinary trigger to examine | Proof to preserve |
|---|---|---|
| Statutory heir who knew the family relationship | Knowledge of death | Death notice, message, funeral travel and civil record |
| Statutory heir who learned heirship later | Later knowledge if the heir can prove it | DNA/civil-status decision, correspondence and discovery record |
| Heir appointed by will | Official notification of disposition | Will-opening and service documents |
| Heir requesting official inventory | Special inventory and choice provisions | Court request, inventory completion and notifications |
| Important reason prevented action | Possible court extension/new period | Detailed obstacle evidence and prompt application |
| Alleged manifestly insolvent estate | Separate deemed-disclaimer analysis | Debt, enforcement and asset position at death |
Which Turkish court receives the declaration?
The declaration is made to the civil court of peace identified by the Civil Code’s estate rules, ordinarily connected with the deceased’s last domicile. Confirm the deceased’s official last domicile and any special international-jurisdiction issue rather than filing wherever the heir’s lawyer is located. The court records the declaration in the designated register and can issue documentation.
The statement must be unconditional and unqualified. “I renounce only the debts,” “I renounce unless the apartment is valuable,” or a partial selection among estate assets is not a proper express disclaimer. The filing should identify the deceased, death, heir, basis of heirship, trigger date and unequivocal renunciation. Attach reliable civil-status and authority documents.
Renouncing from abroad through a power of attorney
An heir need not assume that a flight to Turkey is the only route. A Turkish consulate can often prepare a Turkish-form power of attorney, or a foreign notary may be used with apostille or legalisation and a certified Turkish translation, depending on the country and instrument. The Hague Apostille Convention applies only between relevant contracting parties and within its scope.
Renunciation is a significant act, so the power should contain clear, specific authority to disclaim the identified inheritance and conduct the court proceeding. A generic litigation clause may be challenged as insufficient. Confirm the proposed wording, the deceased’s details, court use and identity spelling before execution. Do not hand an original to an unverified intermediary.
The Ministry of Foreign Affairs consular procedures portal should be checked for appointment and document requirements. Authentication delay is a reason to start early, not proof that the statutory period stopped.
Conduct that may forfeit the right to renounce
Article 610 protects necessary preservation and ordinary administration but provides that an heir who interferes in estate affairs beyond that scope, performs acts not required for administration, conceals estate property or appropriates it cannot renounce. The line depends on facts. Securing a leaking apartment may preserve value; selling its contents and keeping the proceeds may evidence acceptance or prohibited intermeddling.
- do not withdraw or distribute estate bank money for personal use;
- do not sell, gift, pledge or register estate assets as owner;
- do not conceal jewellery, cash, title papers or digital assets;
- avoid signing debt restructuring as though personally liable;
- record emergency funeral or preservation payments separately;
- seek court directions where delay threatens property.
Using the deceased’s bank card or power of attorney after death can create additional issues. Preservation expenses should be documented, proportionate and transparent to other heirs. Obtain advice before acting where the three-month decision remains open.
Investigating assets and debts without accepting
An heir needs enough information to make an informed choice, but private investigation must not become administration or appropriation. Gather statements, title records, enforcement notices, tax debts, guarantees and pending litigation. Ask institutions for information through lawful heir or court channels. Do not sign a settlement simply to obtain a balance.
The formal official-inventory procedure under Articles 619 onward can offer a structured route and later statutory choices, but the request itself has a shorter period that must be assessed immediately. A general estate search is not a substitute. The page on tax and other debts after disclaimer explains why creditor type and timing still matter after a refusal.
What happens to the share after renunciation?
The Civil Code treats the renouncing heir as prescribed for succession to that share, but the destination depends on whether the heir was statutory or appointed, the family structure, the will and whether all nearest heirs renounce. It is unsafe to say simply that the share “goes to the children” or “goes to the state.” Successive heirs may be called, and special liquidation rules can apply when all closest statutory heirs renounce.
Before filing, map who is next. A parent’s decision can expose descendants to a new inheritance call and their own period, subject to age and representation rules. The renouncing person cannot nominate a preferred recipient through an ordinary disclaimer. If the purpose is an agreed redistribution of a solvent estate, another legal instrument may be more accurate, with tax and creditor consequences.
Minors, protected persons and family conflicts
A legal representative acting for a child or protected adult must comply with guardianship and conflict-of-interest safeguards. Parents may have their own interest in the estate, and court permission or a representative may be required. Do not copy an adult heir’s power of attorney or signature arrangement.
Where heirs disagree, each person’s declaration and conduct are assessed separately. One sibling’s acceptance does not automatically prevent another from renouncing, but estate acts performed jointly may require explanation. Obtain copies of any prior filings. If creditors already commenced enforcement, the defence and proof route discussed in enforcement against heirs and disclaimer becomes relevant.
Creditor challenges and abusive renunciation
Renunciation is not always beyond challenge. The Code protects creditors in defined circumstances, including where an insolvent heir renounces to their detriment without adequate security. The applicable parties, period and remedy must be checked under Articles 617–618. A legitimate estate-debt concern should be documented and distinguished from an attempt to shelter the heir’s personal wealth.
Estate creditors and the heir’s personal creditors are not the same group. Bankruptcy-style liquidation after all nearest heirs renounce follows statutory priority and administration rather than private distribution. Do not promise that renunciation makes every connected debt disappear from every person.
Step-by-step filing checklist
- Obtain the death record and identify the succession connection to Turkey.
- Prove statutory or appointed heir status and the knowledge/notification date.
- Calculate the three-month period conservatively and identify any special rule.
- Stop non-preservation dealings and document acts already performed.
- Check assets, debts, next heirs and whether official inventory is appropriate.
- Confirm the competent civil court of peace and declaration wording.
- Execute a special, properly authenticated power of attorney if filing remotely.
- File, obtain the registered court record and address foreign-estate consequences.
What to send for an urgent initial review
Send the death certificate, family/civil-status documents, will and official notification if any, the date and method you learned of the death and heirship, every act taken with estate property, known assets and debts, Turkish last address and any creditor or enforcement paper. State the country where a power of attorney would be signed and whether minors are in the next heir group.
Do not send original testamentary documents, bank credentials or estate valuables through an unconfirmed channel. The filing can often be coordinated from abroad, but the court, governing law and authentication route must be verified. Urgent review should produce a trigger calculation and filing plan, not reassurance based only on the death date.

Frequently asked questions
Is the deadline always three months from death?
No. Statutory heirs generally count from knowledge of death unless later knowledge of heirship is proved; appointed heirs generally count from official notification. Other Code rules may affect the period.
Can I renounce only the debts and keep the property?
No. Express renunciation must be unconditional and unqualified. An heir cannot select favourable estate assets while refusing liabilities through the disclaimer declaration.
Can I sign the renunciation at a Turkish consulate?
A consulate can often prepare the special power of attorney or notarial document needed for Turkish use. The operative declaration must still be filed with the competent court in the legally accepted form.
Does living abroad extend the period automatically?
No. The court may grant relief for an important reason under the Code, but foreign residence or document delay should not be treated as an automatic extension.
May I pay funeral expenses before renouncing?
Necessary, proportionate preservation or funeral acts may differ from acceptance conduct, but record the source and purpose carefully. Obtain advice before using estate money.
What is deemed disclaimer?
It is the Article 605(2) consequence where estate insolvency was officially established or manifest at death. It is not a late version of the express declaration and requires its own proof.
Will my children inherit if I renounce?
They may be called depending on the succession structure and governing law, but the destination is not universal. Map the next heirs before filing, especially where children are minors.
Can I revoke a filed renunciation?
A recorded unconditional renunciation is not a casual reservation. Any challenge based on consent defects or procedure is exceptional and fact-specific; do not file expecting a free change of mind.
Does renunciation stop an existing enforcement case?
Provide the court record in the enforcement file and raise the appropriate objection or action. The correct route depends on the debt, stage and whether disclaimer is disputed.
Can one power of attorney cover all siblings?
Each heir must validly authorise action and conflicts must be considered. A single instrument or lawyer is not automatically appropriate where interests, conduct or next-heir effects differ.
