Tenant Subletting — Unauthorised subletting eviction Turkey review of online listing and occupancy evidence

Direct answer: An unauthorised subletting eviction Turkey claim needs more than one online screenshot. A tenant who transfers a Turkish home or markets it for short stays without the required written consent may breach the lease, but eviction is not automatic. The landlord should preserve admissible evidence, identify whether there is a true sublease, assignment, guest arrangement or tourism rental, follow the correct notice and mediation steps, and avoid unlawful entry or surveillance. Regulatory permit issues and the private eviction claim are related but separate.

2026 legal check: An online listing alone does not establish that an unauthorised sublease occurred or make eviction automatic. For a home or roofed workplace, subletting or transferring use generally requires the landlord’s written consent. Depending on the facts, termination may require a written notice and at least a 30-day cure period under Article 316, unless a statutory immediate-termination ground is established. Short tourism rentals may separately engage Law No. 7464 permitting rules and annually adjusted penalties. Rental disputes generally require pre-suit mediation, and evidence should show actual use, consent, notice and service. The Tenant Subletting assessment must use the current official text and the documents in the individual file.

Unauthorised subletting eviction Turkey: identify the conduct

Start with facts rather than the platform label. A tenant may have a long-term subtenant, transferred the whole residence, accepted repeated paying guests, allowed a family member to stay, found a flatmate or posted an inactive advertisement. Duration, payment, possession, frequency, services and whether the tenant still lives there help distinguish these situations.

Record the first discovery date and every later event. Do not accuse an occupant publicly or demand personal documents without a lawful basis. A precise allegation—who used which property, over what dates and under what arrangement—is easier to prove and to address in a notice than a broad claim that “Airbnb activity” occurred.

The Turkish Code of Obligations regulates sublease and transfer of use. For residential and roofed workplace leases, written landlord consent is central. Review the lease for additional permitted occupants, company housing, sharing or subletting terms, but do not assume a boilerplate clause decides every factual and legal question.

Consent should be traced to the authorised landlord or representative and to the actual arrangement. A casual message approving one named flatmate may not authorise repeated short-term guests. Conversely, a landlord who knowingly accepted a particular arrangement over time may face factual arguments that require careful review. Preserve the complete communication history.

Short-stay tourism law is a separate layer

Law No. 7464 and its implementing framework regulate rental of residences for tourism purposes. Permit, plaque, condominium and operational requirements may apply depending on the arrangement. The legal owner, permit holder, intermediary and tenant can have different roles; a platform listing is not evidence that regulatory approval exists.

The existing guide on short-term home rental permits and Airbnb rules explains owner/operator licensing. This article addresses a different dispute: the landlord says the tenant transferred use or operated listings without consent and seeks contractual termination and eviction. An administrative report does not itself replace the civil procedure.

Preserve online evidence before it changes

Capture the complete page with URL, date, host identifier, photographs, map area, reviews, calendar and price. Save the underlying page or a reliable export where possible, not only cropped screenshots. Make a note explaining who captured it, on what device and how the address match was made. Reviews can help chronology but may contain pseudonyms or inaccurate statements.

Repeat captures can show continuity, yet excessive monitoring or attempts to obtain private information may be unlawful. If formal proof is likely to be contested, discuss a notarial, court or other procedurally reliable evidence-preservation route. Do this before asking a platform or tenant to remove the listing.

Building evidence and personal-data limits

Neighbours, caretakers and management may have observed suitcase turnover, key-box use or repeated unknown occupants. Obtain factual accounts with dates, not collective speculation. Building entry records and camera footage must have been collected and used lawfully; the landlord does not gain unlimited access to personal data merely because a lease dispute exists.

Preserve relevant management complaints, police or security incident references and condominium decisions. Do not publish guest images or names in a residents’ group. Evidence can be delivered to counsel or a competent authority through an appropriate channel while minimising unnecessary personal data.

Confirm that the listing matches the leased home

Interior furniture, views, floor plan, host wording, check-in directions and building features may connect a listing to the unit. Compare these details with the entry inventory and lawful photographs. A pin on a platform map is often approximate and should not be treated as conclusive.

Also consider impersonation or stale content. Ask whether the host account belongs to the tenant, whether reviews fall within the lease period and whether photographs predate the tenancy. A careful evidence chain protects against terminating the wrong lease on a copied listing.

Notice and opportunity to cure

The correct termination route depends on the breach, lease type, severity and facts. Residential and roofed workplace leases can require a written notice and a legally sufficient period to end the breach under the Code of Obligations, while specified serious situations may be treated differently. Do not copy a generic internet notice without checking the legal ground.

The notice should identify the property, relevant lease term, observed conduct and required cure. It should be served by a method that can be proved and should reserve rights without exaggerating evidence. If the conduct continues, preserve post-notice listings or occupancy facts. If it stops, assess whether termination is still legally available rather than assuming the original notice guarantees eviction.

Who must send the notice and who must receive it?

Confirm the current landlord, all registered owners, the lessor named in the contract and any authorised manager. A purchaser, heir or representative should document the legal basis on which they act. Where several tenants signed, or the family-home rules bring another spouse into the lease relationship, service and party selection need individual review.

Use the contractual and legally effective address and a delivery method that proves content as well as receipt or attempted service. A platform message may alert the tenant without satisfying formal notice requirements. Keep the signed notice, attachments, dispatch record and delivery result together, and calculate any cure or filing period from the legally relevant event rather than the drafting date.

Dialogue and settlement without waiving evidence

A factual request for explanation may reveal a copied listing, an approved flatmate or a genuine unauthorised business. Preserve the response and avoid promising that the lease will continue before the facts are assessed. If the parties negotiate surrender, address future bookings, guest access, keys, deposit, damages, listing removal and a fixed delivery date in writing.

Settlement should not leave travellers arriving after possession returns. The tenant should cancel or lawfully transfer bookings through the platform and confirm that key boxes and access codes have been removed. The landlord should not impersonate the host or contact guests with threats.

When conduct may justify a more urgent response

Intentional serious damage, unlawful use, repeated safety incidents or conduct making continuation intolerable may raise routes different from an ordinary remediable breach. These are fact-sensitive exceptions, not convenient labels. Obtain incident, police, fire, management and repair evidence and evaluate proportionality.

Immediate physical danger should be reported to the competent emergency or administrative authority. A landlord should not confront occupants, disconnect utilities, seize belongings or change locks. Even a strong breach allegation must proceed through lawful possession and court mechanisms.

Platform and regulatory reports do not equal eviction

A platform may investigate a listing under its policies, and the Ministry or local authority may examine tourism-permit compliance. Those processes have different evidence, parties and consequences from a lease claim. Removing the advertisement may stop future bookings without resolving the tenancy; an administrative penalty may not deliver possession.

Coordinate the timing of reports with evidence preservation and the civil notice. Provide accurate documents and avoid claiming to be the account holder. If the listing uses the owner’s identity, title document or photographs without authority, flag that specific misuse separately.

Eviction procedure and mandatory mediation

Before filing the appropriate lease action, identify the exact termination ground, defendant, notice, cure period, service and requested relief. Turkish rent and eviction disputes generally require attention to mandatory mediation under current law. The rent-dispute mediation guide explains that preliminary process.

Mediation can address surrender date, booking cancellation, keys, deposit, damage and costs. Any settlement should specify possession delivery and consequences of non-performance. If there is no agreement, preserve the final mediation document and file within the period applicable to the chosen substantive ground.

Damage, income and deposit claims

Unauthorized occupation does not prove a particular monetary loss. Document additional wear or damage with entry and exit evidence, invoices and causation. If the lease permits contractual consequences, assess their validity and proportionality. Claims for platform income or the tenant’s profits require a legal basis and proof; they should not be improvised from nightly list prices.

Account separately for unpaid rent, utilities, building charges, physical damage and any lawful deposit set-off. The guide on tenant damage and lost rent explains physical-loss evidence. A landlord should not double count the same period or retain the whole deposit without an itemised basis.

Evidence-preservation and action checklist

  1. Save the lease, addenda, consent communications and authority records.
  2. Capture the full listing, host profile, calendar, reviews and URL with dates.
  3. Match the property using lawful, verifiable features.
  4. Collect dated factual building reports without public accusation.
  5. Preserve platform, regulatory and police references if any.
  6. Prepare and serve the legally appropriate notice.
  7. Record conduct after notice and any attempted cure.
  8. Complete required mediation and retain the final record.

What to send for an initial review

Provide the signed lease, consent or prohibition wording, owner and tenant details, listing URL and full captures, reasons the unit match is reliable, dated occupancy evidence, management correspondence, any damage or incident record, notice already sent, service proof and the next known booking. Explain whether the tenant still occupies the home.

An initial review should classify the conduct and select the notice, evidence-preservation and mediation path. Do not send unlawfully obtained camera footage, guest identity documents or original lease papers through an unconfirmed channel; describe their existence first so necessity and lawful handling can be assessed.

Frequently asked questions

Does one Airbnb screenshot prove unauthorised subletting?

Not necessarily. It must be matched to the unit, tenant, time and actual or intended use, with authenticity preserved.

Family or guest occupation is not automatically the same as paid subletting. Duration, control, payment, lease wording and facts require review.

For subletting or transfer of use in a residence or roofed workplace, written consent is a central statutory issue. Its scope must fit the arrangement.

Can the landlord enter to inspect?

Not at will. Access must follow the lease, law and reasonable notice or an actual emergency; self-help entry can create liability.

Can the locks be changed immediately?

No. Possession must be recovered through a lawful agreement or procedure, not unilateral lockout.

Does a tourism-permit violation automatically end the lease?

No. Regulatory enforcement and contractual termination are separate, although the same conduct may be evidence in both.

Must the tenant receive time to stop the conduct?

Often the applicable breach route requires a proper notice and cure period, but serious statutory exceptions are fact-specific. Obtain advice before serving.

Can building camera footage be used?

Only after checking how it was lawfully collected, retained and disclosed. Relevance does not erase privacy and data-protection rules.

Can the landlord claim the tenant’s booking income?

That is not automatic. The legal basis, actual receipts, loss and any contractual terms require separate analysis.

What if the listing disappears after notice?

Preserved evidence may still matter, but removal and cessation affect remedy and proof. Continue only through the legally appropriate route.
