Direct answer: A property investment fraud Turkey lawyer should not treat the criminal complaint as the only recovery step. Preserve the bank trail, contract, title or company records, advertisements, identities and original messages; identify whether the promise concerned a real property, company share, construction project, citizenship investment or managed return; and separate suspected criminal deception from the civil act needed to protect money or title.
A prosecutor may investigate, obtain records and seek seizure where statutory conditions exist, but a complaint does not automatically freeze every asset, cancel a title transfer or repay the victim. Urgent civil injunction or precautionary attachment may need to run in parallel against the correct person and asset.
Property Fraud: 2026 legal check
2026 legal check: A failed investment, delayed conveyance or contractual breach is not automatically fraud; prosecutors must assess deception, causal disposition and unlawful benefit. Asset restraint is court- or prosecutor-controlled, not guaranteed. CMK 128/A's temporary account suspension applies only to specified offences and institutions, with short statutory review periods. Since 25 December 2025, newly filed qualified-fraud cases generally begin in the criminal court of first instance, while earlier pending cases follow transitional rules. Civil recovery and title remedies remain separate and fact-dependent. The Property Fraud assessment must use the current official text and the documents in the individual file.
Start with the transaction, not the label “fraud”
Investment disputes arrive in many forms. The seller may never have owned the apartment; the same unit may have been promised twice; a representative may have used a false power of attorney; funds intended for a company increase may have gone to a personal account; or a genuine project may simply have failed commercially. Criminal fraud requires deceptive conduct and intent meeting the Turkish Penal Code. Non-performance, delay or insolvency alone does not prove that intent existed when the money was obtained.
Build a one-page chronology showing each representation, payment and later contradiction. Identify which fact induced the transfer: ownership, licence, guaranteed return, escrow, construction stage, citizenship eligibility or corporate authority. That disciplined chronology prevents a criminal petition from becoming an unfocused contractual history.
Verify the property, company and people
For real estate, obtain the official title record, parcel details, encumbrances and the chain of transfers through lawful channels. A brochure, notarial promise or municipal address is not the land register. For a company investment, collect the trade-registry file, articles, authorised signatories, capital records, shareholder resolutions and bank account ownership. MERSİS and the Turkish Trade Registry Gazette help identify corporate facts; they do not certify that an investment is sound.
The due-diligence steps that should precede a purchase are outlined in the Turkish property due-diligence guide. After suspected fraud, the same records serve a different purpose: linking a statement to its falsity and tracing what happened to the asset or payment.
| Claim made to the investor | Record to obtain | Potential legal significance |
|---|---|---|
| “I own this unit free of debt” | Title history and encumbrance record for the relevant date | Tests ownership, mortgage and prior-transfer statements |
| “Pay the company’s project account” | IBAN holder, SWIFT data and corporate accounting entry | Shows recipient and whether funds entered company books |
| “The project has all permits” | Municipal licence and approved-plan records | Separates an official permit from marketing language |
| “Your shares are registered” | Share ledger, resolution and trade-registry filing where applicable | Tests corporate acquisition and authority |
| “Citizenship is guaranteed” | Official eligibility rules, valuation and annotation documents | Identifies false certainty and missing statutory conditions |
Preserve digital and financial evidence immediately
Export complete conversations with metadata and attachments. Keep original emails, voice files, call logs and advertising pages; a collage of screenshots can obscure dates and accounts. Download bank statements in authenticated form and request transfer identifiers. For cryptocurrency, preserve wallet addresses, transaction hashes, exchange receipts and account-verification records. Do not access another person’s device or account unlawfully in the name of gathering proof.
Record websites and listings before they disappear, but distinguish what was visible when payment was made from later changes. Identify witnesses who attended meetings or translated. Preserve powers of attorney, notarial papers and passport copies supplied during the transaction. Where a title transfer is disputed, delay can permit onward transfer to a third party and make the civil position more complex.
Property investment fraud Turkey lawyer review: building the complaint
Under the Criminal Procedure Code, an offence may be reported to the public prosecutor or competent law-enforcement authority. A useful petition identifies the suspect if known, the deceptive act, why it was false when made, how it caused the transfer, the benefit obtained, the loss and the location of each supporting record. It should distinguish known facts from inference and propose targeted investigative steps.
Requests may include obtaining bank records, interviewing witnesses, securing platform or telephone records, examining company books and checking title movements. The authority decides lawful investigative measures; a victim cannot command a blanket freeze. Overstating the case, naming uninvolved relatives or attaching altered translations can undermine credibility and expose the complainant to avoidable disputes.
If the prosecutor later issues a decision of no prosecution, the procedural stage changes. The separate guide on objecting to a Turkish no-prosecution decision explains the two-week objection framework following service. That objection is not a substitute for preparing the initial evidence properly.
Criminal seizure is conditional, not automatic
Criminal seizure and asset measures protect an investigation and possible confiscation under statutory conditions. They require judicial or prosecutorial process, a connection between suspected offence and property, and the evidential threshold applicable to the measure. Article 128 of the Criminal Procedure Code contains specific rules for seizure of assets, rights and receivables; its scope and predicate-offence conditions must be checked against the alleged offence.
A request should identify traceable assets and explain the link rather than ask to “freeze everything.” A transfer to an innocent third party, jointly owned property, secured creditor or ordinary business account raises competing rights. MASAK may provide financial intelligence within its legal function, but it is not a private collection office that releases money on a victim’s email request.
Civil injunction, precautionary attachment and title protection
A civil claim can seek the remedy the victim actually needs: repayment, contract rescission, damages, title cancellation and registration, or a declaration concerning corporate rights. An interim injunction under the Civil Procedure Code may preserve a disputed right where a change in circumstances would make enforcement difficult or cause serious harm, subject to approximate proof and usually security. A monetary claim may instead call for precautionary attachment under the Enforcement and Bankruptcy Law, which has different conditions.
Choosing the wrong measure matters. A claimant seeking return of a specific title may need a land-register notation linked to the title action. A creditor seeking money cannot assume that a general injunction replaces the statutory attachment route. The page on fraudulent title transfer, cancellation and injunction addresses title-focused relief. Broader property disputes are mapped in the Turkish real-estate disputes guide.
Coordinate criminal and civil cases without double counting
The same facts can support criminal investigation and civil recovery, but the proceedings have different purposes and evidential questions. A criminal court determines criminal responsibility and does not ordinarily calculate and award the victim’s full private-law loss as a civil judgment. The civil court may consider evidence from the criminal file but must decide the pleaded private remedy.
Do not wait automatically for the criminal case if an asset is moving or a civil limitation period is running. Conversely, a rushed civil pleading can make admissions inconsistent with the criminal account. Use one verified chronology, payment table and document index across both routes. Credit any amount recovered so the same loss is not claimed twice.
Calculate the recoverable loss rather than the sales promise
Start with transfers actually made, money or property returned, value genuinely received and direct expenses. Expected profit or a guaranteed yield may be disputed for remoteness, uncertainty, illegality or lack of proof. Exchange-rate treatment and interest depend on currency, obligation and requested remedy. A victim cannot simply convert every marketing projection into damages.
If the investor received a title worth less than represented, valuation date and defect matter. If the title is cancelled, restitution accounting may include possession, rent, improvements, taxes and encumbrances. If a citizenship-related purchase is involved, immigration consequences should be evaluated separately; cancellation of an investment arrangement is not itself a promise about nationality status.
Foreign victim, service and power of attorney
A foreign victim can report a Turkish offence and pursue civil remedies, but identity, translations, address for service and representation must be organised. A power of attorney issued abroad may require consular execution or notarisation, apostille/legalisation and sworn translation depending on the country and intended act. Title litigation can require express authority.
Provide names exactly as shown in passports and banking records. If the suspect used transliterations or multiple companies, create an identity table rather than merging them by assumption. A Turkish property lawyer may coordinate registry and court work; the service overview at property lawyer services in Turkey gives context, but the engagement scope should be confirmed in writing.
Complaint and claim deadlines
Fraud classification affects investigation and limitation. Do not assume a six-month complaint period applies to every fraud allegation; some offences are prosecuted ex officio, while related complaint-dependent offences can differ. Civil claims may be contractual, tort-based, restitutionary, corporate or property claims, each with its own limitation and starting point. Title-cancellation issues also turn on the legal ground and third-party position.
Record the discovery date, service of any prosecutorial decision, payment dates and title movements. A no-prosecution objection is generally time-sensitive after service. Informal settlement talks do not automatically stop every statutory period. Exact deadlines should be calculated from the chosen causes of action and current consolidated legislation.
Common errors after discovering the scheme
- Warning the suspect before securing records, allowing accounts or listings to disappear.
- Sending more money for a fictional “tax,” “release fee” or “refund insurance.”
- Assuming a criminal complaint automatically blocks the land register.
- Using only translated screenshots and discarding originals.
- Suing the brand name instead of the legal seller, recipient or title holder.
- Describing commercial failure as fraud without evidence of initial deception.
- Seeking a blanket asset freeze without identifying the asset and legal connection.
- Waiting for the prosecutor while a separate civil period or onward transfer risk continues.
A route-selection framework
- If title is still in the victim’s name, protect possession and registry access while examining money claims.
- If title was transferred by alleged fraud or false authority, prioritise the title chain and appropriate registry-related measure.
- If only money was transferred, identify the debt basis and whether precautionary attachment conditions can be shown.
- If deception at inception is evidenced, prepare a fact-specific criminal complaint with trace requests.
- If the project is merely delayed or insolvent, analyse contract, corporate and enforcement remedies without forcing a criminal label.
Documents for an initial recovery review
For an initial review, send copies of the contract and annexes, all payment records, title or share documents, powers of attorney, advertisements, complete message exports, identity/company details, existing complaints and a dated one-page chronology. Add a table matching each payment to the stated purpose and recipient. Do not send original title papers or disclose passwords through an unconfirmed channel. The first review should answer four questions: what was promised, what was false, where the asset or money went, and which urgent measure is legally matched to the desired recovery.
Frequently Asked Questions
1. Will filing a criminal complaint freeze the suspect’s assets?
No. Asset measures require the competent authority, statutory conditions, evidence and a demonstrated connection. A separate civil measure may be needed.
2. Does breach of a property contract prove fraud?
No. Fraud requires deceptive conduct and intent; delay, insolvency or breach can remain a civil dispute.
3. Can the prosecutor return my money?
The investigation may trace and secure relevant assets, but a complaint is not an automatic repayment judgment. Civil recovery often requires separate action.
4. What if payment went to a personal account?
That is important evidence but not conclusive alone. Identify the account holder, stated reason, corporate records and later use of funds.
5. Can I cancel a fraudulent title transfer?
Potentially, through the appropriate civil title claim if its legal elements are proved. Third-party acquisition and registry history must be examined urgently.
6. Should I contact MASAK directly?
Financial intelligence and freezing powers operate through statutory processes. Give traceable financial evidence to the competent prosecutor and follow official reporting channels.
7. Can I proceed from outside Turkey?
Often yes through properly documented representation, although some statements or formalities may require personal or consular steps.
8. Is cryptocurrency impossible to trace?
No. Public transaction hashes and exchange records may help, but attribution, jurisdiction and access to provider data can be difficult.
9. Should I settle if part of the money is offered?
Settlement may be sensible, but verify source, payment completion, release scope, security and effect on title or criminal allegations before signing.
10. What happens if the complaint is closed?
A reasoned no-prosecution decision may be challenged within the applicable period after service. Civil rights must be assessed independently.
