Long-Term Residence — Long term residence permit in Turkey file with residence cards, travel records and a continuity calendar

Direct answer: A long-term residence permit in Turkey is not granted simply because a foreign national has held cards for eight calendar years. Law No. 6458 requires at least eight years of uninterrupted permit residence or satisfaction of a separate Migration Policies Board condition, and it also tests recent social-assistance history, sufficient and stable resources, valid medical insurance, and public-order or public-security concerns. Some periods do not count at all and student residence counts differently.

A refusal or later cancellation must therefore be reviewed against the applicant’s complete permit and travel history, not an online day total. Long-term status offers broad rights but is not citizenship. It may be cancelled, including where the holder remains continuously outside Turkey for more than one year for reasons other than health, education or compulsory public service in the holder’s country.

2026 legal check: Long-term residence generally requires at least eight years of qualifying continuous residence, sufficient and regular means, valid medical insurance, no recent social-assistance reliance and no public-order or security bar. Student-residence periods and time spent abroad are not always counted in full. Refusal or cancellation grounds, service date and available court remedy must be checked under the version of Law No. 6458 applicable to the decision.

What a long-term residence permit in Turkey actually is

Long-term residence is an indefinite residence-permit category regulated by Articles 42–45 of the Foreigners and International Protection Law. It is different from repeatedly extending a short-term permit, and it is not the same as permanent residence terminology used by another country. The decision is made through the migration administration under the statutory conditions.

The status can be valuable to an established resident because Article 44 gives rights broadly comparable to citizens, subject to stated exceptions. The holder does not gain voting rights, eligibility for public office, exemption from military service or unrestricted entry into public service merely by receiving the card. Social-security rights remain governed by their own conditions. Citizenship, nationality protection and a Turkish passport require a separate legal basis and procedure.

The first audit lists every Turkish residence permit from the proposed filing date backwards. Gaps, late extension applications, cancellation periods, time under another legal status and days outside Turkey must be reconciled with official migration records. Holding an old card is evidence of the printed validity period; it does not prove that every day is legally countable.

The law refers to uninterrupted permit residence. Its implementation provisions govern how time abroad and interruptions are calculated. Because the calculation has changed through legislation and administrative implementation, use the consolidated text and the applicant’s official entry-exit record on the application date. Do not rely on a spreadsheet that treats a pending application, visa stay or irregular stay as though it were an issued residence permit.

This is distinct from the discretionary grounds discussed in the guide on rejection of a Turkish tourist residence permit. A person may once have qualified for short-term residence but still fail the special long-term continuity test.

Which residence periods count, partly count or are excluded?

Law No. 6458 does not place all immigration statuses in one basket. For the relevant residence calculations, only half of a student residence-permit period is counted, while the full duration of other residence permits is generally counted under the statutory calculation rule. The current implementation text and exact permit history must still be checked.

Refugees, conditional refugees, subsidiary-protection beneficiaries, humanitarian residence-permit holders and people under temporary protection are excluded from long-term residence under Article 42. Those labels have precise legal meanings. A foreigner who once held an excluded status and later received an ordinary permit needs a segmented timeline rather than an assumption that the entire stay counts. The article on student residence in Turkey explains that category’s separate purpose and conditions.

Additional eligibility conditions beyond time

An applicant who reaches the time threshold must still establish the other Article 43 conditions. The law asks whether the person received social assistance during the preceding three years, has sufficient and regular resources for themselves and any family they support, has valid medical insurance and does not pose a threat to public order or public security. Each condition should be documented rather than answered with a tick alone.

Income evidence should disclose its source, regularity and ability to cover the relevant household. Foreign income may require statements, tax records, pension evidence and reliable Turkish translations. Insurance must be valid and suitable for the applicant’s circumstances on the relevant date. A criminal record is not automatically identical to a current public-order threat, but material criminal or immigration records must not be concealed. Obtain the authority’s reason rather than speculating about an undisclosed security assessment.

Documents for a defensible application file

  • current and former passports, including renewed or second-nationality passports;
  • all residence cards, extension receipts and reasoned immigration decisions;
  • official entry-exit movements and a separate day calculation showing absences;
  • address registration and civil-status records for supported family members;
  • bank statements, employment or company records, pension proof and relevant tax documents;
  • current health-insurance policy and evidence of coverage;
  • records clarifying any social assistance, conviction, restriction code or prior cancellation;
  • certified translations or authentication where the receiving authority requires them.

Names, passport numbers and birth dates should match across old and new records. A transliteration change can create a false gap. Prepare a table that explains each discrepancy and preserve the original electronic application and appointment records. Do not buy an insurance product or transfer funds solely because an unverified intermediary claims it guarantees approval.

How refusal should be analysed

A refusal review begins with the complete notified decision and service evidence. Identify whether the authority disputes the eight-year calculation, a particular absence, excluded status, social assistance, income, insurance or public order. The response should address that element with primary records. A general statement that the applicant has “lived in Turkey for years” does not answer a calculation finding.

Administrative applications and judicial review have different functions and time effects. The applicable filing period must be calculated from valid service under the current Administrative Judicial Procedure Law and the specific decision; an informal meeting or renewed online application should not be assumed to stop it. If a refusal appears together with a removal decision, those are separate acts with different routes and potentially different periods. See residence-permit rejection combined with removal for that two-decision problem.

A court does not simply replace the administration’s fact-finding because the applicant prefers a different outcome. The challenge should identify a legal, factual, procedural or proportionality defect and submit the record that was overlooked or misunderstood.

When can long-term residence be cancelled?

Article 45 provides cancellation where the foreigner poses a serious public-security or public-order threat. It also addresses remaining continuously outside Turkey for more than one year for reasons other than health, education or compulsory public service in the person’s country. This rule concerns cancellation after long-term status, not the same continuity calculation used to qualify initially.

The word “continuously” and the stated exceptions matter. Collect border movements and the records supporting the reason for the stay abroad. A health exception needs medical evidence tied to dates; education needs enrolment and attendance evidence; compulsory service needs an official record. Family care, employment or inability to travel may be important facts but should not be relabelled as a statutory exception without a legal basis.

A person whose permit was cancelled because of extended time abroad may have a route to apply again under the current law and implementing rules. That should be verified with the Presidency of Migration Management rather than described as automatic reinstatement.

Long-term residence, humanitarian status and other alternatives

If the eight-year or other conditions are not met, the correct response is not to force the long-term category. The person may need to maintain an existing family, student, work-linked or short-term status, depending on lawful grounds. Humanitarian residence is an exceptional and discretionary regime, not a substitute chosen for convenience; the guide on humanitarian residence and governorate discretion explains its different role.

Work permits can serve as lawful stay under their own legislation, but their interaction with residence history must be verified from official records. A citizenship application may have different residence and eligibility tests. Never allow an existing status to expire because another application is expected to succeed.

Evidence preservation and safe application practice

Download appointment confirmations, application forms, payment receipts and electronic notices with their original metadata. Retain expired passports and residence cards. Ask for correction of a mistaken movement or identity record through the competent official channel, and keep proof of the request. If the administration takes an original, request a receipt.

Do not submit altered travel spreadsheets, undisclosed passports or funds temporarily circulated to simulate regular income. A contradiction may affect both eligibility and credibility. Where the applicant used several names, prepare civil-status proof showing the connection. Sensitive financial and health records should be sent through a confirmed secure channel with unrelated identifiers masked for initial review.

What to send for an initial long-term residence review

Provide passport identity and stamp pages, every permit type and date, the official entry-exit history, any refusal or cancellation with notification record, current address, household details, income source, insurance and a brief explanation of any time outside Turkey. For a cancellation based on absence, add a day-by-day timeline and documents proving the reason abroad.

A preliminary audit can be organised remotely regardless of the province handling the application, but the competent migration unit, appointment and litigation venue depend on the actual record. The review should produce a countable-period table, a missing-document list and a deadline analysis—not a promise of approval.

Frequently asked questions

Do eight years of living in Turkey guarantee long-term residence?

No. The period must be legally countable and uninterrupted, and the applicant must also satisfy assistance, resources, insurance and public-order conditions. Physical presence without the required status is not enough.

Does my student permit count for all eight years?

The statutory calculation generally counts half of student residence-permit time, while other residence permits are treated differently. Build the calculation from the exact permit types and current text.

Does visa-free time count as residence-permit time?

A visa or visa-exempt stay is not itself an issued residence permit. The official chronology should distinguish those periods and any properly filed transition application.

Can a temporary-protection holder obtain long-term residence after eight years?

Article 42 excludes temporary protection, as well as the listed international-protection and humanitarian categories, from long-term status. A later ordinary permit requires its own timeline analysis.

Must I prove income earned in Turkey?

The law focuses on sufficient and regular resources, but the source and documentation must be acceptable and lawful. Foreign pension or investment income may be relevant if it is genuine, accessible and documented.

Is a long-term permit the same as Turkish citizenship?

No. It grants an indefinite immigration status and broad rights with statutory exceptions. It does not confer nationality, a passport, voting rights or every right reserved to citizens.

Can my permit be cancelled because I lived abroad?

Article 45 addresses continuous absence exceeding one year, subject to listed reasons such as health, education and compulsory public service. The dates and supporting evidence must be checked.

Does an objection automatically suspend a refusal?

Do not assume so. The effect depends on the act and chosen route. Valid service, court period and any separate removal decision require immediate individual analysis.

Can I correct a missing entry or exit before applying?

Seek correction through the competent authority with passport and travel evidence. Keep the submission receipt; do not conceal the inconsistency or alter an unofficial spreadsheet.

Can the application be handled while I am outside Turkey?

Long-term residence rests on the applicant’s Turkish status and procedures may require presence or an appointment. Document review can begin remotely, but travel should be planned only after confirming the current official process.
