Early Lease Termination — Tenant leaves lease early Turkey handover, re-letting and deposit calculation

Direct answer: When a tenant leaves lease early Turkey does not automatically impose every remaining month of fixed-term rent. Without a contractual or statutory justification, liability is generally assessed under the Turkish Code of Obligations for the reasonable period in which the property could be re-let on similar terms, subject to any suitable replacement tenant and the landlord’s conduct. The surrender date, condition, advertising, applications, new lease and deposit accounting determine the real dispute.

2026 legal check: Leaving the property does not automatically end every payment obligation. Under the Turkish Code of Obligations, exposure may continue for a reasonable reletting period, while a suitable replacement tenant and the landlord’s conduct can affect the assessment. Notice, key delivery, inspection records and deposit evidence are critical. Confirm the current statute, controlling Court of Cassation decisions and the specific lease terms before calculating liability. The Early Lease Termination assessment must use the current official text and the documents in the individual file.

First distinguish physical departure from legal surrender. Moving furniture out, stopping utilities or messaging “I have left” may not prove when possession and control returned to the landlord. Record the notice, proposed handover, key delivery, inspection and the landlord’s response. If the landlord retakes control and re-lets, that chronology must be preserved.

This article assumes the tenant has attempted or completed early surrender and focuses on remaining rent, re-letting and set-off. The existing guide on proving key return and the end of rent liability examines the threshold evidence of possession return. An unresolved key-return date can still decide the calculation.

Read the lease, addenda and notice history

Collect the signed lease, renewal or extension correspondence, inventory, deposit record and any early-termination clause. Note the fixed term, rent date, notice addresses, use, furnished items and restrictions. A clause demanding every remaining month should not be applied mechanically without checking mandatory law, facts and the landlord’s actual loss.

Establish why the tenant left. Mutual agreement, serious defect, landlord breach, transfer, hardship or an ordinary change of plan may engage different rules. Do not present a negotiated termination as abandonment. Save any message in which the landlord accepted a date, agreed a fee, requested keys or promised to return the deposit.

The reasonable re-letting period is fact-specific

The Code of Obligations addresses return before expiry by reference to a reasonable time in which the property could be rented under similar conditions. That is not automatically one, two or three months. Location, season, property type, condition, lawful rent terms, market demand and the landlord’s marketing choices can affect the assessment.

A large commercial unit may need a different period from a standard apartment. An unusually high asking rent, refusal to show the property or a decision to renovate for the landlord’s own objectives can interrupt the claimed causal chain. Conversely, a tenant cannot assume immediate re-letting where the property needs agreed reinstatement or the market is demonstrably slow.

Mutual termination can replace the default dispute

Parties can reduce uncertainty by signing a clear surrender agreement. It should identify the effective date, key handover, rent and utility balance, deposit treatment, damage inspection, furniture, pending claims and whether either side releases defined obligations. General language such as “everything is settled” may generate a second dispute if the figures or exceptions are not attached.

Do not sign a backdated handover or acknowledge an amount that has not been calculated. If the landlord accepts keys “without prejudice,” clarify what remains disputed. If a payment is made as a fixed early-exit settlement, state whether it replaces or merely credits any later rent claim. Each side should retain an executed copy and evidence of every settlement payment.

Residential and commercial facts require separate attention

The statutory early-return principle may be relevant across lease types, but the reasonable period and evidence can differ sharply. A commercial tenant may have fit-out removal, reinstatement, licences, turnover, specialist premises and a narrower replacement market. A residence may involve household timing, furnished inventory and more frequent comparable listings.

Do not import a residential assumption into a warehouse or shop file. Identify permitted use, assignment or sublease provisions, value of tenant improvements and any agreed reinstatement. Specialist valuation or market evidence may be needed where each side proposes a very different re-letting period.

A suitable replacement tenant can reduce liability

A departing tenant may present a person who is ready to assume the lease, solvent and acceptable on reasonable grounds. Suitability must be examined honestly: identity, income, intended use, household or business needs, proposed start date and willingness to accept the relevant lease conditions. The replacement should not be fictional or merely interested.

Keep the application, supporting documents, date sent and landlord response. The landlord may have legitimate grounds to reject a proposed substitute, but silence or arbitrary demands can become relevant to continued loss. Sensitive personal data should be shared only to the extent necessary and through a secure method.

The landlord should document re-letting conduct

Advertise promptly on realistic terms and keep dated listings, agent instructions, inquiries, viewings, applications, rejections and negotiations. A claim for vacancy should show what was done to place the property back on the market. If rent is increased substantially or new conditions deter applicants, explain how those decisions relate to the previous lease and market.

When a new lease is signed, preserve its execution and commencement dates, agreed rent, rent-free period and any works. Confidential third-party data can be redacted as appropriate, but the material terms may be necessary to calculate when the earlier tenant’s loss exposure ended. The landlord cannot recover overlapping rent for the same period.

Repairs, cleaning and marketing delay

Separate ordinary wear from tenant-caused damage. A necessary repair period caused by the tenant may affect re-letting, while elective improvement or long-planned renovation may not be chargeable in the same way. Compare the entry inventory, checkout record, dated photographs and invoices. Estimates alone may not show that work occurred or what it cost.

The article on tenant damage and lost rent deals with physical damage. An early-exit claim should keep damage delay, ordinary vacancy and agreed reinstatement obligations in separate calculation lines.

Security deposit is not the final month’s rent

A tenant should not simply stop paying because the landlord holds a deposit. The deposit’s form, amount and custody arrangements must be reviewed under the Code of Obligations and the lease. At the end, the parties should prepare an itemised account for unpaid rent, utilities or charges, proven damage and any lawful early-surrender loss.

The landlord should not label the entire deposit “forfeited” without matching deductions to a legal and evidential basis. The tenant should request the calculation and supporting invoices or rent chronology. The existing article on excess deposits and foreign-tenant discrimination covers the deposit ceiling and equal-treatment issues, which are distinct from end-of-lease set-off.

How to build the monetary calculation

Create a month-by-month ledger from the last paid rental period. Add rent or contractually allocated charges claimed for the legally relevant vacancy period. Credit payments, the deposit amount lawfully applied, rent from a replacement tenant and any other avoided expense. List repair loss separately with invoices and the reason it delayed re-letting.

Do not assume the new rent proves the old loss. A higher rent may end or reduce vacancy loss but can involve concessions, agent commission or a later start. A lower rent may raise questions about market conditions and reasonable mitigation. Interest and procedural costs depend on maturity, demand, route and eventual decision.

Foreign tenants and remote handover

A tenant leaving Türkiye should organise a written handover before travel. If a representative will return keys, use clear authority and record the landlord’s receipt. Photograph meter readings and the property, close or transfer utilities appropriately, and provide an address for notices. Shipping keys without confirmed delivery is risky.

Remote participation may be possible through a properly issued power of attorney, but document form, translation and apostille or consular requirements should be checked. Do not leave originals with an unverified intermediary. A flight date supports the chronology but does not alone establish legal surrender.

Demand, mediation and court or enforcement routes

The landlord’s demand should state the surrender date relied on, reasonable re-letting period, new lease information, each monetary item, credits and evidence. The tenant’s response should identify agreed termination, substitute candidates, marketing problems, deposit and disputed damage. Unsupported global figures make settlement harder.

Turkish lease disputes generally require attention to mandatory mediation before court proceedings, subject to the current law and dispute type. The guide on mandatory mediation in rent disputes explains the process. Enforcement may be considered for a sufficiently definite debt, but an objection can move the dispute into litigation.

Evidence-preservation checklist

  1. Lease, addenda, inventory, deposit proof and full payment ledger.
  2. Early notice, landlord response and any mutual termination terms.
  3. Key delivery, inspection, access and meter evidence.
  4. Replacement-tenant applications and screening responses.
  5. Dated listings, viewings, offers and new lease terms.
  6. Entry/exit photographs, invoices and repair dates.
  7. Itemised deposit account, demands, mediation and enforcement papers.

Export complete message threads rather than selected screenshots. Retain listing URLs and capture dates because advertisements change. A party should preserve evidence favourable and unfavourable to its position; later deletion can undermine credibility.

What to send for an initial review

Send the lease and addenda, last payment date, exact reason for leaving, notice and key chronology, landlord acceptance or refusal, proposed replacement tenant material, advertising and new-lease information, entry/exit evidence, deposit proof and an itemised amount claimed. State any mediation or filing date already notified.

The initial review should identify whether surrender is proved, the plausible re-letting window, disputed mitigation, damage delay and deposit credits. Do not send original keys, lease or sensitive third-party application documents through an unconfirmed channel.

Frequently asked questions

Must the tenant pay every month left in the fixed term?

Not automatically. The reasonable re-letting period, a suitable replacement and the actual chronology must be assessed under the applicable rules.

Is mailing the keys enough?

It may not prove accepted surrender. Use a documented delivery or lawful procedure that establishes when control was offered and returned.

Is there a fixed three-month penalty?

No universal period should be assumed. The reasonable re-letting time is fact-dependent, and any agreed clause requires legal review.

Can the landlord reject a replacement tenant?

There may be reasonable grounds, but the candidate’s readiness, solvency and willingness to take suitable terms—and the landlord’s reason—should be documented.

Can the landlord increase the asking rent after surrender?

They can market the property, but an unrealistic increase may affect whether all resulting vacancy is attributed to the former tenant.

Can the deposit cover remaining rent?

It may be included in the final lawful account, but the tenant should not unilaterally treat it as rent and the landlord should itemise any set-off.

Does renovation extend the former tenant’s liability?

Only where the delay is legally attributable, such as proven tenant-caused repair. Elective upgrading requires separate analysis.

What if the property was re-let immediately?

Actual replacement rent generally matters and overlapping recovery should not occur. Check start dates, concessions and any remaining proven loss.

Can the dispute be handled while I am abroad?

Many steps may be handled through counsel and a valid power of attorney, but service, evidence and attendance requirements are file-specific.

Does mediation stop every deadline?

Do not make that assumption. The effect depends on the applicable procedure and dates; obtain prompt advice.
