Direct answer: Turkish inheritance tax for foreign heirs normally requires four coordinated steps: establish heirship, file the inheritance and gift tax return within the deadline determined by the places of death and taxpayer residence, complete the tax office’s valuation and release requirements, and register succession at the Turkish land registry. The inheritance tax deadline is not one universal date. Under Law No. 7338, a death in Turkey generally gives a taxpayer in Turkey four months and a taxpayer abroad six months; where death occurred abroad, the matrix can be four, six or eight months depending on where the taxpayer is located relative to the country of death.
Annual exemptions, tariff bands and administrative forms change, so use the official Revenue Administration guide for the death year. Civil-law ownership passing by succession does not remove tax reporting or registry formalities, and foreign-national property eligibility must be checked separately.
Turkish Inheritance Tax: 2026 legal check
2026 legal check: Foreign heirs may need a Turkish certificate of inheritance, an inheritance-tax filing, civil-status evidence and Land Registry documents before title transfer can be completed. Tax exemptions, brackets, payment schedules and administrative forms may change, while property-acquisition restrictions can depend on nationality and location. Confirm the 2026 Revenue Administration figures, current Land Registry practice and the property record before stating the tax or transfer timetable. The Turkish Inheritance Tax assessment must use the current official text and the documents in the individual file.
Separate heirship, tax and title registration
A certificate of inheritance identifies heirs and shares for its legal purpose; it is not a tax return. Filing a tax return does not prove that the filer owns the property. Paying an assessment does not itself update the land register. The land registry then checks the succession and current transfer documents before recording the heirs.
These tracks should be planned together because each may request records generated by another. An heir abroad may need a Turkish tax number, authenticated identity and civil-status documents, a Turkish inheritance certificate, municipal or other asset values, the filed return and a tax-office letter. The exact list is confirmed with the competent Revenue Administration office and TKGM procedure at action time.
Turkish inheritance tax for foreign heirs: when it applies
Inheritance and Gift Tax Law No. 7338 contains its own personal and territorial connecting rules. Foreign nationality alone does not create a blanket exemption. Turkish-situs assets and the citizenship/residence connections described by the statute must be analysed. A substantive inheritance rule and a tax rule can reach the same estate for different reasons.
List all Turkish assets and relevant debts, including land, bank deposits, securities, company interests, vehicles and receivables. The return position for an asset should be based on legal ownership, not possession. Property held by a Turkish company belongs to the company; the inherited asset may be shares. Joint ownership does not automatically make the whole asset taxable in one estate.
The statutory filing-deadline matrix
Article 9 uses the location of death and the taxpayer’s location. The following table summarises the ordinary death-based periods in the official law checked on 20 September 2026. The precise facts, service and any special event such as a declaration of absence must still be verified.
| Where death occurred | Where the taxpayer/heir is located | Ordinary filing period |
|---|---|---|
| Turkey | Turkey | Within four months following death |
| Turkey | A foreign country | Within six months following death |
| A foreign country | Turkey | Within six months following death |
| A foreign country | The same foreign country where death occurred | Within four months following death |
| A foreign country | A different foreign country | Within eight months following death |
| Declaration of absence | As specified by Article 9 | Special one-month period linked to finality of the absence decision |
“Taxpayer location” should be documented, not guessed from nationality. If heirs live in different countries, their return analysis may differ. Do not postpone filing because a foreign probate case is slow without checking whether a provisional or subsequent corrective process is available. Penalties and interest for late filing depend on tax procedure and facts; obtain a current calculation rather than inventing a flat amount.
Which tax office and how foreign heirs file
Competence follows the rules in Law No. 7338 and current Revenue Administration practice, considering the deceased’s last residence and relevant estate connections. Foreign heirs should confirm whether the return will be filed at the competent Turkish tax office, through an available digital service or by an authorised representative. Digital Tax Office functions change and access may depend on a Turkish taxpayer identity and verification.
A Turkish lawyer or tax professional may act under a properly drafted power of attorney. The authority should cover tax-number applications, filing, assessment receipt, payment or refund steps and collection of official letters as needed. A foreign power generally requires the applicable apostille or legalisation and Turkish translation. Do not assume a land-sale power authorises tax declarations.
Valuing inherited assets correctly
Inheritance tax does not use “today’s market price” indiscriminately. Law No. 7338 and Tax Procedure Law No. 213 prescribe valuation measures for asset categories and permit tax-administration review. Turkish immovable property, listed or unlisted securities, business interests, foreign currency, receivables and household contents may be valued under different rules. The relevant date is tied to the taxable event.
For land, obtain the official municipal/tax value and accurate title characteristics; do not substitute an estate agent’s asking price without legal basis. For bank assets, request the balance and accrued items at the relevant date. For a company, obtain financial and registry records rather than declaring the company’s gross property as personally owned. Disclose foreign-currency conversion method from the applicable official rule.
The administration may assess values after the heir’s declaration. Keep the submitted schedule, supporting valuations and assessment notice. A later property sale price can be relevant to another tax or dispute, but it does not automatically rewrite every inheritance-tax valuation.
Annual exemptions, tariff bands and payment
Inheritance-tax exemptions and tariff brackets are updated through annual official measures. Use the GİB general communiqué and guide applicable to the year of death; do not copy last year’s lira figures. The relationship of the heir to the deceased and the net taxable share can affect the calculation. Gift rates and inheritance rates are not identical.
Tax payment follows the statutory and assessed instalment framework. Read the assessment document for due dates, payment reference and any effect of correction or litigation. A title or bank-release procedure may require a tax-office letter even where instalments continue. “Tax filed,” “tax assessed,” “tax paid” and “no transfer obstacle” should be documented as separate statuses.
From inheritance certificate to title registration
The land registry needs legally sufficient proof of succession. Depending on the estate, that may be a Turkish inheritance certificate issued by a court or notary within authority. A foreign certificate can require authentication, translation, recognition or a Turkish certificate and may not operate directly for Turkish immovables. See using a foreign certificate of inheritance in Turkey.
Next obtain a current title record, identify mortgages, attachments or annotations, complete tax-office requirements and prepare identity, photograph or power documents currently requested by TKGM. The registry records the succession shares established by the operative certificate; it does not privately redistribute them because heirs agree orally. A later partition, sale or transfer is a separate transaction.
The guide on partition of co-owned Turkish property explains the next stage when heirs cannot agree. Do not begin a sale before title, authority, tax and co-owner positions are clear.
Property restrictions affecting a foreign heir
Land Registry Law and special legislation can restrict acquisition or retention based on property type, location, area or nationality. Inheritance treatment is not identical to an ordinary purchase, but a foreign heir should still obtain a nationality-and-property eligibility check. Agricultural land and company-owned property can involve additional regimes.
If the heir cannot lawfully retain an inherited immovable, a statutory liquidation or disposal process may follow; that is the subject of liquidation of Turkish property a foreign heir cannot acquire. Do not misdescribe that exceptional case as a general prohibition on foreigners inheriting Turkish property.
Bank assets and tax-release controls
Banks verify heirship, identity, tax compliance and their own account obligations before releasing estate money. A court certificate does not remove a bank’s duty to apply Law No. 7338 transfer controls, account security, set-off or sanctions checks. Obtain a date-of-death balance and the bank’s written deceased-customer checklist.
The article on how an heir abroad collects Turkish bank deposits addresses release mechanics. For tax filing, include the asset accurately even if the bank has not paid it out. If only some heirs seek distribution, check whether joint estate ownership or representation prevents unilateral release.
Foreign tax, treaties and double-charge questions
The country of the deceased or heir may also tax the estate, inheritance or later capital gain. Whether a treaty applies, and whether domestic law offers credit or relief, is country-specific. A treaty for income tax is not automatically an inheritance-tax treaty. Obtain the exact instrument in force at death.
Keep Turkish returns, assessments and payment receipts in a form usable abroad, with certified translation where required. Conversely, foreign tax payment should be disclosed to the Turkish adviser but should not be deducted or credited without a statutory basis. Coordinate filing dates so one country’s valuation and ownership statements do not contradict the other’s.
Document and evidence checklist
- death certificate showing place and date, properly authenticated and translated;
- Turkish inheritance certificate or the full foreign heirship/probate record;
- passports, taxpayer numbers, residence addresses and family-status documents;
- title records, municipal values and property identifiers for each immovable;
- date-of-death bank, investment, vehicle and company records;
- documented deductible debts and expenses claimed under the applicable law;
- filed return, annexes, assessment, payment receipts and tax-office release letter;
- power of attorney, apostille/legalisation and Turkish translations;
- foreign tax filings and treaty/relief material where relevant.
Scan the complete return and every annex before submission. Do not send original title deeds or passports by ordinary post. Mask unrelated financial transactions during initial review but leave dates, account holder and relevant balances visible.
A coordinated filing and registration workflow
- Fix the death place, each heir’s location and the earliest tax deadline.
- Establish heirship and identify foreign-document formalities.
- Inventory Turkish assets, debts, ownership and property eligibility.
- Obtain statutory values and use the current year’s GİB guide.
- File with complete annexes and preserve stamped/electronic proof.
- Address assessment, payments and the required transfer-release record.
- Apply to TKGM with current succession, identity and authority documents.
- After registration, plan partition, retention or sale as a new transaction.
What to send for an initial tax-and-title review
Provide the death certificate, death country, each heir’s country of residence, inheritance certificate or family tree, Turkish asset list, title details, bank/company records, known debts, any prior return and the proposed use of the property. State whether another country has opened probate or imposed estate tax.
Review can be coordinated for property anywhere in Turkey, while tax-office and land-registry competence follow official rules. A useful first assessment identifies the applicable filing row, missing valuations, property restrictions and authority documents. It cannot responsibly quote tax from an estimated market value alone.

Frequently asked questions
Do all foreign heirs have six months to file?
No. The statutory period depends on where death occurred and where the taxpayer is located. The ordinary matrix ranges from four to eight months, with special events governed separately.
Is nationality the same as taxpayer location?
No. The Article 9 deadline matrix uses factual/statutory location, not merely passport nationality. Document the heir’s location during the relevant period.
Must I pay all inheritance tax before title transfer?
Obtain the current tax-office transfer/release requirement and assessment schedule. Filing, assessment, payment instalments and permission for asset transfer are separate statuses.
Can I use market value for the apartment?
Use the valuation measure prescribed by Law No. 7338 and Tax Procedure Law for the asset and relevant date. A broker’s asking price is not automatically the inheritance-tax value.
Does a foreign probate grant update the Turkish land register?
Usually further Turkish proof and procedure are required. Authentication, translation, a Turkish inheritance certificate or recognition may be necessary before TKGM acts.
Can a foreigner inherit Turkish land?
Often yes, but nationality, property type, location and special acquisition restrictions must be checked. Some cases lead to disposal rather than indefinite retention.
Is inherited property automatically split into physical rooms or parcels?
No. Heirs usually receive legal shares in co-ownership until an agreement or judicial partition. Registry succession does not itself create a physical division.
What if the return is already late?
File strategy, penalty, interest and voluntary-disclosure possibilities require current tax-procedure review. Do not delay further while waiting for a perfect valuation without advice.
Will tax paid abroad cancel Turkish inheritance tax?
Not automatically. Check the exact foreign tax, Turkish domestic relief and any applicable inheritance-tax treaty. An income-tax treaty may not cover inheritance.
Can I sell immediately after title registration?
A sale is a separate transaction requiring authority, co-owner agreement or partition, current tax and title checks, and compliance with any foreign-ownership restriction. Analyse its own tax consequences.
