Workplace mobbing Turkey employee evidence chronology and private-employer response

Direct answer: A workplace mobbing Turkey employee claim is assessed as a sustained, targeted pattern of psychological pressure, humiliation, isolation or intimidation rather than as a label for every argument, critical appraisal or unpopular management decision. A private-sector employee should preserve a dated chronology and lawfully obtained records, notify an appropriate employer channel where reasonably safe, and choose remedies according to whether employment continues, the employee resigns for just cause, or the employer dismisses them.

The employer should protect personality rights, investigate impartially, prevent retaliation and document a proportionate response. Compensation, reinstatement and discrimination routes have different elements and deadlines; none follows automatically from an allegation of mobbing.

2026 legal check: Workplace mobbing generally requires assessment of a systematic, repeated pattern; a single disagreement or lawful performance measure is not automatically mobbing, although it may create another claim. TBK 417 requires employers to protect employees' personality and prevent psychological or sexual harassment. Internal reporting, ALO 170, TİHEK, mediation, justified termination and compensation are fact-dependent routes, not cumulative guarantees. Immediate termination based on morality and good-faith grounds can engage the six-working-day and one-year periods in Labor Law Article 26. Evidence must be preserved lawfully.

This guide concerns private employment, not public personnel

The first classification is the employment relationship. A worker employed under a private employment contract usually relies on the Turkish Code of Obligations, Labour Law and labour-court procedure. A civil servant or other public employee may instead need an administrative application and administrative-court route. Mixing those systems can send a valid complaint to the wrong authority.

This page is confined to private employees and employers. It does not duplicate the site's guide to administrative remedies for a public employee. It also does not assume that a company director, partner or consultant is necessarily an employee; status depends on the real working relationship, authority and contract.

Workplace mobbing Turkey employee test: what may qualify?

There is no useful one-sentence formula that decides every file. Courts examine the conduct as a whole: repetition, duration, targeting, power imbalance, purpose or effect, objective seriousness and impact on the employee. Examples may include a coordinated effort to isolate one worker, persistent degrading messages, impossible or meaningless tasks used as pressure, baseless disciplinary accusations, systematic exclusion from information, threats or repeated attacks on professional dignity.

A single rude comment can still breach personality rights, equality rules or workplace discipline, but it is not automatically a mobbing pattern. Lawful performance management, a supported warning, restructuring, a reasonable change within managerial authority or an isolated interpersonal dispute likewise does not become mobbing simply because it causes stress. The legal analysis should identify each act and any separate claim instead of forcing every event into one label.

Classify the conduct before choosing a remedy

Observed conductQuestion to testPossible legal focus
Repeated exclusion, ridicule or targeted impossible workIs there a documented pattern directed at one employee?Mobbing, personality protection, employer duty and damages
Action linked to sex, disability, age, religion, ethnicity or another protected groundDoes the evidence connect treatment to a statutory protected ground?Equal-treatment claim and potentially TİHEK, in addition to labour remedies
One insult, threat, assault or sexual actDoes the incident independently violate civil, labour or criminal law?Incident-specific protection; repetition is not required for every separate wrong
Evidence-based appraisal or warning applied consistentlyWas it proportionate, genuine and free from discriminatory or retaliatory motive?Ordinary management unless the wider facts show abuse
Dismissal after a complaintWas there a valid reason and fair process, or evidence of retaliation?Reinstatement, termination compensation and discrimination analysis

The employer's duty to protect the employee

Article 417 of the Turkish Code of Obligations requires an employer to respect and protect the employee's personality and to maintain workplace order consistent with honesty. It expressly addresses protection against psychological and sexual harassment and against further harm to a victim. Occupational health and safety duties may also be relevant where psychosocial conduct creates a health risk.

An employer should provide a credible reporting route, preserve confidentiality as far as a fair investigation allows, hear both sides, protect witnesses from retaliation and impose a proportionate measure supported by findings. A promise of absolute anonymity may be misleading if the accused must understand and answer the substance. Conversely, circulating sensitive medical or complaint material beyond those who need it can create a separate privacy problem.

Practical first steps while employment continues

  1. Write a contemporaneous chronology with date, time, location, words or action, participants and witnesses.
  2. Keep the applicable contract, job description, policies, appraisals, targets, warnings and organisational changes.
  3. Preserve messages and documents to which you lawfully have access; retain original metadata where possible.
  4. Use the designated manager, ethics, HR or board channel unless that route presents a concrete safety or conflict concern.
  5. Describe verifiable events and the requested protective step rather than relying only on the word “mobbing.”
  6. Seek medical help when needed, without asking a clinician to make legal findings outside their expertise.
  7. Obtain advice before resigning, recording conversations, removing company files or signing a settlement.

A carefully framed complaint gives the employer an opportunity to stop the conduct and creates evidence of notice. It is not an admission that internal reporting is always a legal prerequisite. The urgency and safe route depend on threats, health, seniority of the accused and available safeguards.

Evidence: relevance, authenticity and lawful collection

Useful evidence may include emails, workplace messages, meeting invitations, repeated task changes, comparative workloads, complaint receipts, investigation records, witness accounts, performance history, sickness records and the sequence between a complaint and adverse action. A medical record may prove symptoms and timing; it does not by itself prove who caused them or that the legal test for mobbing is satisfied.

Do not secretly access another person's account, export customer databases, take trade secrets or manufacture a conversation. Secret audio is not automatically lawful or admissible. Courts consider how evidence was obtained, whether there was an otherwise unavoidable need, privacy, proportionality, authenticity and the circumstances. Preserve originals and obtain advice before relying on covert material. The related guide on workplace camera and audio monitoring explains why recording and employment evidence require separate privacy analysis.

How an employer should investigate

Appoint an investigator without a reporting-line conflict, define the allegations and relevant period, issue preservation instructions and interview the complainant, accused and material witnesses separately. Test records against objective data: targets, allocations, meeting lists, comparable employees and earlier appraisals. Give the accused a genuine opportunity to respond without exposing irrelevant health or family information.

The written outcome should distinguish substantiated facts, unsubstantiated claims and matters that cannot be resolved. Possible responses include restoring reporting lines, stopping contact, training, mediation only where freely appropriate, discipline or termination where the legal grounds exist. Follow-up is part of prevention: check for retaliation and whether the measure worked. An investigation should not be designed to create a predetermined dismissal record.

Remedies while staying, resigning or after dismissal

An employee who remains may request protective action, cessation of conduct and correction of false records, and may reserve compensation or equal-treatment rights. An employee considering just-cause termination must identify the precise statutory ground, prove the facts and communicate termination clearly. Resigning in general language or waiting too long after a particular event can create disputes about causation, notice pay and severance.

If the employer dismisses the employee, reinstatement may be available only if the statutory coverage and service/workplace conditions are met. The short procedure is critical: an eligible employee generally applies for mandatory mediation within one month of the termination notice, and if no agreement is reached, brings the reinstatement action within two weeks after the final mediation record. A dismissal communicated informally can still require immediate assessment; see dismissal by WhatsApp in Turkey.

Possible claims and their different legal foundations

Depending on the facts, a private employee may claim unpaid employment entitlements, severance following a valid employee termination, notice or dismissal consequences, pecuniary loss, non-pecuniary damages for injury to personality, equal-treatment compensation or reinstatement. The same evidence does not automatically prove each head of loss. A compensation request should explain the unlawful act, employer responsibility, causation and actual loss or personal harm.

There is no universal “mobbing compensation tariff.” Courts assess the proven conduct and legal basis. A criminal complaint is not a substitute for labour analysis: only conduct matching a defined offence should be reported as such. Likewise, the Human Rights and Equality Institution of Türkiye (TİHEK) route is relevant where the statutory discrimination or harassment scope, protected ground, respondent and application requirements are met—not for every unpleasant workplace.

Deadlines depend on the chosen remedy

There is no single limitation period called the “mobbing deadline.” Counsel must identify the claim, when it accrued, whether conduct continued, the termination date and whether mediation suspends or affects time under the applicable rules. Wage and employment receivables, tort/personality claims, reinstatement and statutory termination powers do not share one clock.

Labour Law Article 26 contains special timing rules for termination based on conduct contrary to morality and good faith; it must be analysed separately for the particular act and discovery. Reinstatement uses the one-month mediation trigger described above. Because a late filing cannot be repaired by relabelling the same facts, obtain a chronology review before sending a resignation or waiting for an internal process to end.

Mandatory mediation and settlement design

Many employee-employer receivable, compensation and reinstatement disputes require mediation before a labour-court action under Law No. 7036. The application should identify the correct employer entity and claims while preserving deadlines. Mediation is confidential, but underlying workplace documents do not become unusable merely because they existed before the session.

A settlement should specify payment categories, dates, tax/social-security treatment where applicable, release scope, reference wording, return of property and confidentiality limits. It should not suppress lawful reporting or rely on a generic release that the parties do not understand. Foreign employees should also examine work-permit, residence and repatriation consequences; the guide on foreign workers' permits, wages and severance addresses those separate issues.

Common mistakes on both sides

  • Calling a single disagreement mobbing without pleading any independently unlawful conduct.
  • Using a copied complaint with no dates, speakers, documents or requested protection.
  • Assuming a medical report conclusively proves employer conduct.
  • Removing confidential company data or making indiscriminate secret recordings.
  • Allowing the accused manager to control preservation or the investigation.
  • Retaliating through shifts, targets or dismissal after a complaint.
  • Resigning before analysing just cause, wording, evidence and Article 26 timing.
  • Missing the one-month reinstatement mediation period while an internal appeal continues.

What to send for an initial case review

Send a concise chronology, contract and job description, employer identity and headcount information, the complaint and response, relevant messages, appraisals, warnings, medical/sick-leave records, witness list, termination or resignation document and mediation papers. For each event, explain where the original record is kept. Do not send a full company server export, unrelated employee data or original devices through an unconfirmed channel. A focused review can classify the conduct, urgent deadline, evidence gaps and realistic employment route, but it cannot promise a finding of mobbing or a compensation amount.

Frequently Asked Questions

1. Is one serious incident mobbing?

Usually mobbing analysis looks for a pattern. A single serious incident may nevertheless support another labour, civil or criminal remedy on its own facts.

2. Must I complain to HR before going to court?

Not in every case, but a safe internal notice may prove employer knowledge and permit protection. The contract, risk and chosen claim should be reviewed first.

3. Can ordinary performance criticism be mobbing?

Genuine, proportionate and consistently applied appraisal is not automatically mobbing. Fabricated targets, humiliation or selective pressure may change the assessment.

4. Can I secretly record my manager?

Do not assume recording is lawful. Necessity, privacy, proportionality, authenticity and how it was obtained can determine admissibility and separate liability.

5. Does a psychologist's report prove mobbing?

It can support symptoms and timing, but the court still determines conduct, responsibility and causation using the full evidence.

6. Can I resign and receive severance?

Possibly if a proven statutory just cause exists and termination is properly made. An unsupported or ambiguously worded resignation can defeat the claim.

7. Is TİHEK available for every mobbing complaint?

No. Its jurisdiction requires the elements and scope of Law No. 6701, including a relevant discrimination framework where applicable.

8. Can a dismissed employee seek reinstatement?

Only if statutory eligibility requirements are met. The mediation application is generally due within one month after the termination notice.

9. Is the employer liable for a co-worker's conduct?

Potentially, especially where the employer knew or should have known and failed to protect the employee, but responsibility depends on the relationship and response.

10. Can an employer discipline a complainant if the claim is unproven?

An unproven good-faith complaint is not the same as a deliberately false accusation. Any discipline needs an independently lawful, proportionate and documented basis.
