Traffic accident compensation Turkey foreigner claim file with police, medical and insurance records

Direct answer: A claim for traffic accident compensation Turkey foreigner status can include documented treatment costs, temporary or permanent loss of earning capacity, care needs, other accident-linked expenses and non-pecuniary damages, depending on injury, fault, insurance and proof. Foreign nationality does not prevent a Turkish claim. Secure the police or gendarmerie record, vehicle and insurer details, photographs, witness contacts, complete Turkish and overseas medical files, travel costs and reliable earnings evidence.

Identify every responsible person and policy, then complete any required insurer application before litigation or insurance arbitration. Neither fault nor compensation is automatic, and limitation must be calculated from the facts and any related criminal offence.

2026 legal check: A bodily-injury claim against a compulsory traffic insurer requires a prior written application; if the insurer gives no adequate response within 15 days, suit or insurance arbitration may become available. The usual period is two years from knowledge and ten years from the accident, subject to longer criminal limitation. Compulsory insurance pays only within its scope and limits, and moral damages are generally outside that cover. A police report is important but not conclusive on fault. Foreign earnings, disability, causation and uninsured expenses require evidence; not every private or overseas medical cost is automatically recoverable. The Traffic Accident Compensation assessment must use the current official text and the documents in the individual file.

Protect health and evidence in the first hours

Call emergency services and law enforcement where appropriate, accept necessary medical care, and avoid signing a document you do not understand. Ask for an interpreter if a statement is taken in Turkish. Photograph the vehicles, road, signals, markings, debris, weather and visible injuries if it is safe. Record the registration plates and the driver, owner, operator and insurer information.

A tourist may leave Türkiye soon after the accident, making contemporaneous records unusually important. Obtain the emergency record, discharge summary, imaging, prescriptions, invoices and fitness-to-fly advice before departure. Keep boarding passes and receipts for replacement travel. Later recollection cannot fully replace a dated medical record connecting symptoms to the collision.

Do not wait for one file to answer every issue. A traffic record may address the scene but not final civil fault. A medical report may describe an injury but not calculate long-term loss. The compensation file combines these records through the proper evidential and expert process.

Identify the driver, operator, owner and insurers

The driver’s conduct is central, but liability may extend under the Highway Traffic Law to the vehicle operator and, depending on the facts, an employer, rental business, public body, road authority, contractor or another vehicle. Registered ownership is important evidence but the statutory operator analysis may require control and economic use. A multi-vehicle collision should be mapped vehicle by vehicle.

Compulsory motor-liability insurance can answer covered third-party loss subject to legislation, current general conditions and policy limits. It does not erase the potential liability of the tortfeasor or guarantee every claimed item. Comprehensive or travel insurance may have a different role. Obtain policy data through legitimate channels and notify relevant insurers without giving an inaccurate final settlement statement.

Fault evidence and contributory conduct

Police observations and the accident sketch matter, but a preliminary percentage is not necessarily the final civil assessment. Road-camera footage, vehicle event data, tachograph records, mobile data obtained lawfully, road design and expert reconstruction may change the analysis. Preserve video promptly because retention periods can be short.

The injured person’s own conduct can affect compensation. Seatbelt or helmet use, pedestrian location, speed, intoxication or acceptance of a known risk must be proved and linked to the injury or loss; they should not be assumed from nationality or vehicle position. Do not repair or dispose of a materially relevant vehicle before evidence needs are considered. The overview of road-accident injury, death and criminal proceedings in Turkey explains how the public case and compensation evidence interact.

Connect Turkish and overseas medical treatment

Build one chronological medical file beginning with the ambulance or first hospital. Include diagnostic images, operation reports, pathology where relevant, prescriptions, physiotherapy, disability and work-capacity assessments. If treatment continues abroad, obtain records identifying the diagnosis, medical necessity, provider, dates and cost. Translate key documents into Turkish through an accepted process when required.

A later diagnosis can still be accident-related, but a long undocumented gap invites a causation dispute. Explain the reason for delay, including travel, access or evolving symptoms. Keep evidence of pre-existing conditions so an expert can distinguish prior impairment, temporary aggravation and new injury. Hiding a previous condition can damage credibility; its existence does not automatically defeat a claim.

Prove foreign earnings and economic loss

A foreign visitor’s income cannot safely be reduced to an unsupported salary figure or assumed Turkish minimum wage. Provide employment contract, employer confirmation, payroll, bank credits, tax returns and absence or sick-pay records. A self-employed claimant should add accounts, invoices, customer history and evidence of replacement labour. Explain the currency, gross/net treatment and social benefits.

Economic heads may include reasonable treatment and rehabilitation costs, lost earnings, reduced earning capacity, care or household assistance, transport and other causally connected expenses. Some medical or social-security payments may need coordination. Preserve receipts but also explain why each cost was necessary. Future loss usually requires medical, vocational and actuarial evidence rather than multiplying a current salary by years.

Non-pecuniary damages are individually assessed

Turkish courts may award non-pecuniary damages for the physical and emotional consequences of personal injury. There is no automatic tariff payable merely because an accident occurred. Courts consider the injury, treatment, lasting effects, fault, circumstances and fairness under the Code of Obligations. Evidence should describe real impact without exaggeration.

Photographs, clinical notes, treatment duration and credible statements about daily limitations can assist. The separate guide on how Turkish courts assess moral damages after a traffic accident examines this head specifically. It should not be confused with the calculation of economic disability loss or policy coverage.

Prepare the insurer application before choosing a forum

The Highway Traffic Law and insurance framework require a pre-insurer application for relevant compulsory-insurance claims before certain proceedings. The required documents and response or waiting period must be checked under the current statute, policy general conditions and forum rules. Send an indexed application to the correct insurer and retain verifiable proof of delivery.

Describe the accident, liability basis, injuries and each quantified or reservable loss. Attach available records and explain what remains pending, such as stable-disability assessment. Do not sign a broad release simply to obtain an interim payment without understanding its scope and validity. If the insurer requests additional material, respond precisely and preserve both the request and answer.

Court, insurance arbitration and settlement

After the statutory pre-application step, possible routes may include negotiation, the Insurance Arbitration Commission or court, depending on the respondent, policy, dispute and jurisdiction. Arbitration has its own application, evidence, award, objection and review structure. It is not automatically faster or better for every complex injury claim. Confirm the current monetary and procedural rules on the Commission’s official site.

A settlement should itemise which heads, persons, policies and future claims it covers. Translate it for a claimant who cannot read Turkish. Consider whether the injury has stabilised and whether future surgery, disability or care remains uncertain. The insurer’s policy limit may not cap the tortfeasor’s entire legal exposure, but collectability and overlapping claims matter.

Criminal proceedings do not pay the civil claim automatically

An injury collision may produce a criminal investigation for negligent injury or another offence. The victim can preserve procedural rights and evidence in that file, but a prosecution does not itself calculate and collect all civil compensation. Likewise, an acquittal does not always answer every civil issue because standards, parties and fault questions can differ.

Obtain the investigation number, expert reports and decision status lawfully. Coordinate statements so the factual account remains accurate across files. A compensation petition should still prove claimant, defendant, fault, causation and each loss. Do not delay the civil or insurer work merely because the criminal file remains open.

Cross-border documents, authority and payment

A claimant abroad can generally act through Turkish counsel with an appropriately prepared power of attorney. Depending on the issuing country, notarisation, an apostille or consular legalisation and Turkish translation may be required. Confirm wording before signing. Identity, residence, family and earnings documents may require similar formalities for evidential use.

Keep original-currency records and conversion evidence. An overseas medical invoice should identify provider and service, not just a card total. Bank, tax and employer documents need enough context to be understood in Türkiye. Cross-border compensation logistics are also discussed in the travel context in the guide to flight and baggage compensation in Turkey, but road-accident liability follows its own rules.

Calculate limitation from the accident and legal classification

Highway Traffic Law Article 109 contains time rules commonly expressed by reference to knowledge of the damage and liable person, with a longer period from the accident. Where the act also constitutes an offence with a longer limitation period, that criminal period may affect compensation claims. The correct result can depend on the accident date, injury discovery, defendant, claim type and charged conduct.

Do not treat continuing treatment as automatically postponing every deadline. Notify insurers and investigate while evidence is available. Record accident, knowledge, policy, application, service and criminal-file dates in one table. Suspension, interruption and amendments require case-specific analysis under the current consolidated legislation.

Foreign claimant document checklist

  1. Passport, contact details and travel entry/exit records.
  2. Police or gendarmerie report, sketch and investigation number.
  3. Vehicle, driver, operator and insurer information.
  4. Scene photographs, video, witness contacts and camera requests.
  5. Complete Turkish and foreign medical records and diagnostic images.
  6. Invoices, travel changes, care, rehabilitation and other expense proof.
  7. Employment, business, tax and bank evidence of income and absence.
  8. Insurer application, delivery proof, correspondence and any offer or release.

Common mistakes in a foreign visitor claim

  • Leaving Türkiye without obtaining the first medical and police records.
  • Accepting a preliminary fault note as the final legal answer.
  • Submitting only translated summaries rather than original foreign records.
  • Claiming foreign earnings without payroll, tax or banking support.
  • Starting arbitration or suit before completing a required insurer application.
  • Signing a Turkish release without understanding future-claim language.
  • Assuming the criminal case will award and collect compensation.
  • Waiting for medical stability without protecting the earliest possible deadline.

What to send for an initial review

Send the accident report and file number, scene evidence, vehicle and policy details, all medical records, photographs, passport/travel dates, expense receipts, earnings proof, insurer correspondence and any settlement document. Provide a chronology of symptoms, treatment, work absence and return travel. Identify where each document originated and what still needs collection. A first review should map liable parties and coverage, preserve video and official evidence, assess the pre-application route, flag limitation and identify missing medical or income proof; it cannot guarantee liability, an amount or collection.

Frequently Asked Questions

1. Can a tourist claim compensation after a road accident in Turkey?

Yes. Nationality does not bar a claim, but Turkish liability, insurance, procedure and evidence rules must be applied.

2. Must I remain in Turkey during the claim?

Not always. Many steps can be handled through properly authorised counsel, although medical examination, testimony or other attendance may sometimes be required.

3. Will compulsory insurance pay every loss?

No. Coverage, causation, policy limits, exclusions, fault and the type of loss must be assessed. Other responsible parties may also matter.

4. Can I claim income earned outside Turkey?

Potentially, if the loss is causally linked and reliably documented through employment, tax, business and banking evidence.

5. Is the police fault percentage final?

Not necessarily. Courts and other forums may consider additional evidence and expert analysis.

6. Can treatment in my home country be included?

Potentially, where it is medically necessary, reasonable and connected to the accident. Keep complete clinical and payment records.

7. Do I apply to the insurer before court or arbitration?

Relevant compulsory-insurance claims commonly require a prior insurer application. Verify the current documents, delivery and waiting requirements.

8. Does a criminal conviction guarantee compensation?

No. It can be important evidence, but the civil or insurance claim must establish its parties, losses, causation and procedure.

9. Should I accept an early insurer offer?

Only after understanding injury stability, included loss heads, policy position and the scope of any release. Early settlement can waive disputed future claims.

10. What is the deadline?

There is no safe one-line answer. Highway Traffic Law Article 109, knowledge dates, defendants and any longer criminal limitation must be assessed promptly.
