2026 proportional attorney fee rates
In lawsuits and proceedings involving money or values that can be valued in monetary terms, fees are not calculated using a single rate. The value of the lawsuit is divided into the following tiers; each part is subject to its own rate. Therefore, showing the tiers separately in the calculation of attorney fees is important.

The difference between fixed and proportional attorney's fees
This is the fixed minimum amount specified by the Tariff for a specific case or type of work, regardless of the monetary value of the dispute.
This is the fee calculated with tiered rates as the amount of money in question increases. The rate for each tier is different.
If the proportional calculation falls below the fixed fee stipulated for the court, the fixed limit is generally taken into account; the fee cannot exceed the awarded amount.
Points to Consider When Calculating Attorney's Fees
The counterclaim fee awarded by the court is not the same as the fee agreed upon in the attorney fee agreement. The counterclaim fee is considered within the scope of litigation costs and is evaluated according to the provisions of the Tariff. The fee between the lawyer and the client is determined according to the Attorneys' Law, the contract, and the scope of the legal assistance provided; it cannot be agreed upon below the Tariff.
In enforcement proceedings, payment of the debt before or after the service of the payment order, objections, collection phase, and the nature of the proceedings can affect the outcome. Separate evaluations should be made for serial lawsuits, consumer arbitration boards, mediation, dissolution of partnerships, and provisions in special laws. This calculator shows the full proportional fee and basic fixed items.
Frequently Asked Questions about Attorney Fees
How to calculate attorney's fees for a 1,000,000 TL lawsuit?
16% is applied for the first 600,000 TL, and 15% for the remaining 400,000 TL. In this example, the proportional fee is 156,000 TL; the acceptance-rejection rate and Tariff provisions are also taken into account in the specific case.
To whom does the opposing party's attorney's fee belong?
Under Article 164 of the Attorneys' Law, the attorney's fee charged to the opposing party belongs to the attorney. The contractual obligation between the client and the attorney is separate from this.
Is VAT included in the attorney's fee?
This calculator shows the AAÜT amount; it does not calculate VAT and withholding tax. The parties to the self-employment receipt and tax status should be evaluated separately.
What happens if the value of the case is lower than the fixed fee?
The fee cannot exceed the amount awarded or rejected according to the tariff. The agent applies the lower limit when the proportional fee falls below the fixed limit; however, it limits the result so that it does not exceed the value of the lawsuit.
From when does the tariff apply?
The 2025–2026 AAÜT (Law on the Protection of Legal Aid) has been published in the Official Gazette and entered into force. Which tariff will be applied can be examined separately in terms of the date the legal aid was completed or the judgment was given and the transitional provisions.
