How is work accident compensation calculated?
In calculating compensation for material damages from work accidents, the worker's earnings, age at the time of the accident and report, permanent disability rate, fault of the parties, active and passive periods, and the portion of income paid by the Social Security Institution subject to deduction are considered together.
For the active period, the current net salary is used; for the passive period, the minimum wage or another accepted income can be used depending on the nature of the file.
Economic damage is limited by the permanent disability rate in the authorized health report and the fault rate attributed to the responsible party.
Probable life expectancy is determined using age and gender data from the TRH-2010 national mortality table.

A simplified view of the progressive annuity approach, where income growth and discount rates balance each other for the future period, is used. In the full actuarial report, periodic payrolls, known and unknown periods, and life probabilities can be examined in more detail.
Difference between permanent and temporary disability
Temporary work Disabilityrepresents the loss of earnings during the period of inability to work due to treatment and recovery. Permanent disability covers the loss of future earning capacity in cases where a permanent reduction in working capacity occurs after an accident. Both types of damage may be present in the same event; however, the same period should not be included in the calculation twice.

Frequently asked questions
How is work accident compensation calculated?
The employee's net earnings, age, probable life expectancy, permanent disability rate, fault distribution, and social security payments are evaluated together. Past and future active and passive period losses are calculated separately.
Are disability rate and fault rate the same thing?
No. The disability rate shows the impact of bodily harm on working capacity; the fault rate shows the distribution of responsibility in the occurrence of the accident.
Is moral damages included in this calculation?
No. There is no fixed mathematical tariff in the law for moral damages; criteria such as the severity of the event, the fault of the parties, the impact of the damage, and equity are evaluated by the court.
Can SGK (Social Security Institution) payments be deducted from compensation?
The portion of income linked by the Social Security Institution (SGK) that is subject to recourse or offsetting can be evaluated according to the specific case. Therefore, user input is used instead of a definite automatic deduction in the tool.
Is the calculation result final?
No. The result is only a preliminary assessment. For a definitive calculation, disability, fault, and actuarial reports, as well as actual wage documents, must be reviewed.
